The Directive is an act of European Union law (Article 288 TFEU) which joins together the legislative will at the level of the European Union and the power that the Member State enjoys in what concern its implementation. It ties up together the general and the particular. Nevertheless, more and more allusions (and even accusations) directed against the European legislator concern the comprehensive degree in norms of directives; on the other hand, an important issue related to the Directive is that of application and interpretation of European Union law, especially by courts and tribunals of Romania.
