{"id":4650,"date":"2023-09-19T10:22:28","date_gmt":"2023-09-19T07:22:28","guid":{"rendered":"http:\/\/www.csde.ro\/?p=4650"},"modified":"2023-09-30T16:01:51","modified_gmt":"2023-09-30T13:01:51","slug":"dezbaterea-ne-conformitatea-unor-prelevari-de-probe-adn-cu-principiile-dreptului-uniunii-europene-28-septembrie-2023","status":"publish","type":"post","link":"https:\/\/www.csde.ro\/?p=4650","title":{"rendered":"Dezbaterea Ne\/conformitatea unor prelev\u0103ri de probe ADN cu principiile dreptului Uniunii Europene, 28 septembrie 2023"},"content":{"rendered":"\n<!--more-->\n\n\n\n<p style=\"text-align:center\"><strong>Institutul de\nCercet\u0103ri Juridice al Academiei Rom\u00e2ne<\/strong><\/p>\n\n\n\n<p style=\"text-align:center\"><strong>Centrul de\nStudii de Drept European <\/strong><\/p>\n\n\n\n<p style=\"text-align:center\"><strong>DEZBATEREA<\/strong><\/p>\n\n\n\n<p style=\"text-align:center\"><strong>Ne\/conformitatea\nunor prelev\u0103ri de probe ADN cu principiile dreptului Uniunii Europene<\/strong><\/p>\n\n\n\n<p style=\"text-align:center\"><strong>28 septembrie\n2023, ora 12.30<\/strong><\/p>\n\n\n\n<p style=\"text-align:center\"><strong>Hibrid, Sala\nde Consiliu a Instiutului de Cercet\u0103ri Juridice \u0219i G-Meet<\/strong><\/p>\n\n\n\n<p>Dezbaterea se va focaliza asupra armoniz\u0103rii\ndreptului european \u00een privin\u021ba Legii nr. 118\/2019 privind Registrul na\u021bional\nautomatizat cu privire la persoanele care au comis infrac\u021biuni sexuale, privit\u0103\n\u00eempreun\u0103 cu legisla\u021bia congruent\u0103, care reglementeaz\u0103 cazierul judiciar \u0219i\nsistemul na\u021bional de date genetice judiciare, pe de o parte \u0219i standardele\ndrepturilor omului, consacrate \u00een dreptul Uniunii Europene, \u00een special dreptul\nla via\u021b\u0103 privat\u0103, dreptul la un proces echitabil \u0219i dreptul la protec\u021bia\ndatelor cu caracter personal. <em>Firul ro\u0219u\nal dezbaterii se focalizeaz\u0103 asupra ideii c\u0103 <\/em><em>absen\u021ba controlului judec\u0103toresc asupra \u00eenscrierii \u00een\nregistru \u0219i multitudinea de prelucr\u0103ri de date care se realizeaz\u0103 cu privire la\npersoanele vizate au un caracter excesiv \u0219i dispropor\u021bionat, \u00eenc\u0103lc\u00e2nd grav\ndrepturile fundamentale<\/em>. Pentru aceste motive se\nimpune cel pu\u021bin un control de constitu\u021bionalitate \u0219i o posibil\u0103 trimitere\npreliminar\u0103, formulat\u0103 de c\u0103tre instan\u021be judec\u0103tore\u0219ti investite cu cazuri de\nprelevare a probelor ADN \u00een temeiul Legii nr. 118\/2019.<\/p>\n\n\n\n<p><strong>Participan\u021bi<\/strong>: <\/p>\n\n\n\n<p>prof.
