The article takes stock of the \u2018procedure to allow an appeal to proceed\u2019, that was put in place on 1 May 2019, with the entry into force of Article 58a of the Statute of the Court of Justice of the European Union and with the insertion of a new chapter 1a in Title V of the Rules of Procedure of the Court of Justice (Articles 170a and 170b).
The need to reform the Statute of the CJEU arose from the observation that a significant number of appeals dismissed as manifestly unfounded or manifestly inadmissible were brought in cases which had already been considered twice, and had thus already been subjected to a two-tier review of legality: initially by an independent board of appeal of certain offices and agencies of the EU and then by the General Court.
As of 31 August 2022, that is to say a little over three years after the entry into force of this filtering mechanism, 142 orders have been rendered, pursuant to Article 58a of the Statute of the CJEU, by the chamber of the Court charged with this procedure, the so-called \u2018Chamber determining whether appeals may proceed\u2019.
More importantly, in the last few months, this chamber has adopted the first two orders allowing an appeal to proceed. The article pays particular attention to these two orders, in order to assess the requirements that appellants must meet for their appeal to be allowed to proceed.<\/p>\n\n\n\n
