Ca urmare a participarii la conferinta\u00a0„Probeleme dificile de procedura civila” (8-9 feb.2013)<\/a> [cu tema\u00a0„Suspendarea procedurii de c\u0103tre instan\u0163a judec\u0103toreasc\u0103 din Rom\u00e2nia \u00een situa\u0163ia efectu\u0103rii unei trimiteri preliminare c\u0103tre Curtea de Justi\u0163ie a Uniunii Europene”<\/span>] va \u00a0fi redactat un documentar (impreuna cu Mihai Banu si Dragos Calin) cu privire la dreptul comparat in materia suspendarilor in situatia trimiterilor preliminare in statele membre. <\/span><\/div>\n

In curand in Romania va intra in vigoare un nou cod de procedura civila. Spre deosebire de legislatia anterioara, suspendarea este obligatorie in situatia trimiterii preliminare la CJUE:<\/div>\n
„Art. 412 (1)<\/span><\/em> Judecarea cauzelor se suspend\u0103 de drept: <\/span>7.<\/span><\/em> \u00een cazul \u00een care instan\u0163a formuleaz\u0103 o cerere de pronun\u0163are a unei hot\u0103r\u00e2ri preliminare adresat\u0103 Cur\u0163ii de Justi\u0163ie a Uniunii Europene, potrivit prevederilor tratatelor pe care se \u00eentemeiaz\u0103 Uniunea European\u0103.”<\/span><\/div>\n

\u00cen cadrul unui articol as dori sa fac un examen de drept comparat cu privire la reglementarile din celelate state membre, jurisprudenta nationala pertienta sau statistici relevante daca exista. Va rog daca se poate sa ma ajutati cu reglementari nationale si\/sau bibliografie in acest sens.<\/span><\/p>\n<\/div>\n<\/div>\n

A new Code of civil procedure will be soon in force in Romania. Unlike the previous legislation, under this new legislative framework, the suspension of the main proceedings will become mandatory in case of a reference to the European Court of Justice.<\/div>\n

As provided in the (new) Article 412(1), „the proceedings (i.e. pending before a Romanian court) will be suspended ex officio 7. in case the court make a preliminary reference to the Court of Justice of the European Union, according to the founding Treaties of the European Union”.<\/p>\n<\/div>\n

I am planning to write a paper, in which I intend to rely on comparative law (i.e. on legislative framework and practices of the other Member States, relevant case law, statistics – if any). <\/span>Any help with ideas, examples and so on will be much valuated.
