{"id":5469,"date":"2025-05-22T21:05:01","date_gmt":"2025-05-22T18:05:01","guid":{"rendered":"https:\/\/www.csde.ro\/?p=5469"},"modified":"2025-06-18T19:28:57","modified_gmt":"2025-06-18T16:28:57","slug":"consultari-europene-consultare-a-comisiei-europene-referitoare-la-elaborarea-unui-studiu-de-impact-cu-privire-la-pastrarea-datelor-de-catre-furnizorii-de-servicii-in-scopul-procedurilor-penale-csde","status":"publish","type":"post","link":"http:\/\/www.csde.ro\/?p=5469","title":{"rendered":"Consultari Europene: Consultare a Comisiei Europene referitoare la elaborarea unui Studiu de impact cu privire la p\u0103strarea datelor de c\u0103tre furnizorii de servicii \u00een scopul procedurilor penale (CSDE-SCE-34)"},"content":{"rendered":"\n<!--more-->\n\n\n\n<p><strong>Consult\u0103ri Europene: Consultare a Comisiei Europene referitoare la elaborarea unui Studiu de impact cu privire la p\u0103strarea datelor de c\u0103tre furnizorii de servicii \u00een scopul procedurilor penale (CSDE-SCE-34)<\/strong><\/p>\n\n\n\n<p>Centrul de Studii de Drept European din cadrul Institutului de Cercet\u0103ri Juridice al Academiei Romane organizeaz\u0103 o dezbatere privind p\u0103strarea datelor de c\u0103tre furnizorii de servicii \u00een scopul procedurilor penale.<\/p>\n\n\n\n<p>\u201ePentru a combate \u0219i a urm\u0103ri penal \u00een mod eficace infrac\u021biunile, autorit\u0103\u021bile poli\u021biene\u0219ti \u0219i judiciare pot avea nevoie de acces la anumite date care nu se refer\u0103 la con\u021binut prelucrate de furnizorii de servicii de comunica\u021bii electronice. \u00cen absen\u021ba unor obliga\u021bii specifice care s\u0103 impun\u0103 furnizorilor respectivi s\u0103 p\u0103streze datele pentru o perioad\u0103 de timp rezonabil\u0103 \u0219i limitat\u0103, este posibil ca datele s\u0103 fie \u0219terse p\u00e2n\u0103 la momentul \u00een care autorit\u0103\u021bile le solicit\u0103 \u00een scopul procedurilor penale. \u00cen prezent, nu exist\u0103 \u00een acest domeniu niciun cadru juridic la scara UE. Majoritatea statelor membre ale UE se bazeaz\u0103 pe legi na\u021bionale, care difer\u0103 de la un stat membru la altul, \u00eens\u0103 alte state membre nu dispun de norme \u00een vigoare. Lipsa unor norme armonizate de p\u0103strare a datelor pentru categoriile-cheie de date a fost identificat\u0103 de serviciile de poli\u021bie, de parchete \u0219i de autorit\u0103\u021bile judiciare ca fiind o provocare substan\u021bial\u0103 pentru procedurile penale na\u021bionale privind infrac\u021biuni care au loc at\u00e2t online, c\u00e2t \u0219i offline \u0219i \u00eempiedic\u0103 cooperarea transfrontalier\u0103 \u00een \u00eentreaga UE. Acest subiect a fost \u00een centrul discu\u021biilor Grupului la nivel \u00eenalt privind accesul la date, unde exper\u021bii au recomandat adoptarea unui cadru al UE privind p\u0103strarea datelor \u00een scopul asigur\u0103rii respect\u0103rii legii, care s\u0103 acopere \u0219i garan\u021biile privind accesul. At\u00e2t pre\u0219edinta Comisiei, doamna von der Leyen (1) (2), c\u00e2t \u0219i statele membre ale UE, \u00een Concluziile Consiliului privind accesul la date pentru asigurarea eficace a respect\u0103rii legii \u0219i privind consolidarea eforturilor comune de combatere a terorismului, au subliniat recent necesitatea unor m\u0103suri care s\u0103 asigure accesul legal \u0219i efectiv la date \u00een scopul asigur\u0103rii respect\u0103rii legii. \u00cen Comunicarea \u201eProtectEU: o strategie european\u0103 de securitate intern\u0103, Comisia s-a angajat s\u0103 prezinte \u00een 2025 o foaie de parcurs care s\u0103 stabileasc\u0103 calea de urmat \u00een ceea ce prive\u0219te accesul legal \u0219i efectiv la date pentru autorit\u0103\u021bile de aplicare a legii \u0219i s\u0103 acorde prioritate unei evalu\u0103ri a impactului normelor de p\u0103strare a datelor la nivelul UE.\u201d<\/p>\n\n\n\n<p>Denumirea proiectului:<\/p>\n\n\n\n<p><strong>Consult\u0103ri Europene: Consultare a Comisiei Europene referitoare la elaborarea unui Studiu de impact cu privire la p\u0103strarea datelor de c\u0103tre furnizorii de servicii \u00een scopul procedurilor penale (CSDE-SCE-34)<\/strong><\/p>\n\n\n\n<p>Proiectul va fi realizat de:<\/p>\n\n\n\n<p>Prof. univ. dr. Alexandru Silviu Goga<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Dezbaterea a avut loc la data de 16 iunie 2025, ora 18:00, on line.<\/p>\n\n\n\n<div style=\"height:156px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Update<\/p>\n\n\n\n<p><strong>18 iunie 2025: Contribu\u021bia ICJ a fost elaborat\u0103 \u0219i transmis\u0103 Comisiei Europene, put\u00e2nd fi accesat\u0103\u00a0<a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/14680-Impact-assessment-on-retention-of-data-by-service-providers-for-criminal-proceedings-\/F3567075_en\" data-type=\"link\" data-id=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/14680-Impact-assessment-on-retention-of-data-by-service-providers-for-criminal-proceedings-\/F3567075_en\">aici.<\/a><\/strong><\/p>\n\n\n\n<p>Contribu\u021bia ICJ subliniaz\u0103 necesitatea ca viitorul cadru normativ privind reten\u021bia datelor de c\u0103tre furnizorii de servicii s\u0103 respecte exigen\u021bele statului de drept, s\u0103 fie coerent cu jurispruden\u021ba CJUE \u0219i s\u0103 garanteze protec\u021bia efectiv\u0103 a drepturilor fundamentale. ICJ atrage aten\u021bia asupra dezechilibrelor procedurale care pot rezulta din utilizarea dispropor\u021bionat\u0103 a datelor de trafic \u0219i localizare, \u00een lipsa unor garan\u021bii adecvate \u0219i a unui control judiciar riguros. Documentul argumenteaz\u0103 c\u0103 orice nou\u0103 ini\u021biativ\u0103 legislativ\u0103 trebuie s\u0103 fie fundamentat\u0103 pe o analiz\u0103 clar\u0103 a schimb\u0103rilor de context care s\u0103 justifice reluarea unei teme invalidate anterior de jurispruden\u021ba european\u0103.<\/p>\n\n\n\n<p><strong>Rezumatul contribu\u021biei ICJ:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Forma actului \u0219i temeiul juridic trebuie s\u0103 fie alese astfel \u00eenc\u00e2t s\u0103 asigure respectarea principiului subsidiarit\u0103\u021bii \u0219i a caracterului previzibil al reglement\u0103rii, av\u00e2nd \u00een vedere at\u00e2t componenta de pia\u021b\u0103 intern\u0103 (art. 114 TFUE), c\u00e2t \u0219i cea de protec\u021bie a datelor (art. 16 TFUE);<\/li>\n\n\n\n<li>Este necesar\u0103 corelarea propunerii cu actele legislative existente &#8211; precum GDPR, Directiva ePrivacy, Codul Comunica\u021biilor Electronice, Directiva (UE) 2016\/680 \u2013 \u0219i cu jurispruden\u021ba CJUE (ex.
